2025 Updates to Florida's Live Local Act
The 2025 amendments to Florida's Live Local Act, effective July 1, 2025, clarify and expand the law. Key provisions include:
Mandatory Administrative Approval: Qualifying affordable housing projects on commercial/industrial/mixed-use sites get automatic approval, circumventing lengthy quasi-judicial or administrative board reviews.
Zoning Clarification: The law clarifies that "commercial use" includes properties permitting wholesale sales, rentals, and other for-profit businesses, even if locally zoned differently. It also expands applicability to PUDs (Planned Unit Developments).
Mixed-Use Cap: For mixed-use developments, local governments are prohibited from requiring more than 10% of the total square footage to be used for non-residential purposes.
